Overtime due is the most important of the daily or average overtime. Therefore, employers must deduct all daily overtime paid to employees from the total average overtime period to determine whether overtime is due at the end of the average period. The average overtime period is calculated as if the employee had worked the remaining scheduled positions during the average period (the rules apply for the daily or average period). If a collective agreement provides for something else, the obligation to move from one position to another must be consistent with the collective agreement.  the order of business for each working day covered by the agreement. If overtime is due during the average period, some additional calculations are required. These calculations ensure that hours are not counted twice, both as average duration and as flexible time. The calculation is as follows: the break must be taken before the end of the next average period. If this is not the case, the employer must pay the worker his normal wage for the hours not taken. Employers can require or allow workers to work modified schedules through a funding agreement. Existing average value agreements remain valid until at the earliest of the following: the payment of overtime remaining during the average period must be paid within ten days of the end of the payment period that ends.

An HWAA group may be concluded at the request of a group of employees or a deputy head, with the agreement of the conclusion of the agreement, to a majority of the staff concerned. In the case of a group agreement, all new employees recruited in the workplace are considered consent and are bound by the agreement.  the start and expiry date of the agreement and the Director of Employment Standards may terminate a funding agreement at any time taking into account any factors that the Director considers relevant.
